UK Grants Bereavement Leave for Miscarriages Before 24 Weeks

In a landmark decision, the UK government has confirmed that individuals who experience a miscarriage before 24 weeks of pregnancy will be entitled to bereavement leave. This move is part of broader workers’ rights reforms that aim to provide greater support for those navigating the emotional and physical impacts of early pregnancy loss.

Recognizing Early Pregnancy Loss

Until now, statutory bereavement leave in the UK was only granted for stillbirths after 24 weeks. The new policy extends the right to two weeks of bereavement leave for parents who lose a pregnancy earlier — a change long sought by advocates and supported by growing awareness of the emotional toll miscarriage can take.

Labour MP Sarah Owen, Chair of the Women and Equalities Committee, emphasized the significance of this shift: “Miscarriage is a bereavement, not an illness. People deserve time to grieve without fear of job loss or financial hardship.”

The reform ensures that early pregnancy loss is no longer invisible in employment law and that individuals can take time off without needing to use sick leave or unpaid time.

A Step Toward Compassionate Policy

The Miscarriage Association welcomed the change, describing it as a “monumental step” in legitimizing the grief experienced by thousands each year due to early pregnancy loss. While the leave will initially be unpaid, the inclusion of miscarriage in bereavement protections sets the groundwork for future progress, including the possibility of paid leave.

Business Minister Justin Madders noted: “This is about recognizing loss. Bereavement is not a holiday — it deserves recognition in its own right.”

Wider Workers’ Rights Reforms

This development is part of the wider Employment Rights Bill, which also proposes enhanced protection from unfair dismissal starting on day one of employment, improved sick pay, and restrictions on exploitative practices like zero-hours contracts and fire-and-rehire tactics.

The recognition of miscarriage in this legislation is a significant cultural and legislative shift, sending a clear message that pregnancy loss — regardless of when it occurs — is valid and deserving of compassion.
